Rules

●  “Applicants” shall mean those persons who fulfill the criteria in the Terms and Conditions.
●  Applicants must apply under the region where they currently reside: if your application is successful then proof of residence will be required.
●  You cannot apply if living outside of Kenya.
●  Applicants can only apply once for Gold and/or Silver and/or Cheza Dimba Award each year.
●  Applicants may apply once a month for the Bronze Award.
●  Applications must be submitted prior to their region’s competition deadline. No late entries will be accepted. See calendar for further information.
●  Applicants must submit a complete application form with correct information together with certified copies of identification documents, any misleading     details  will result in the non-consideration of your application.
● Applicants must provide a valid reference with their up-to-date contact details when applying for the Gold or Silver Awards.
● Only shortlisted Gold and Silver Award applicants will be contacted.
● Cash prizes will only be given for the Bronze Award (Payments made within 21 days of announcement).  
● Gold and Silver awardees will have their products or services purchased and delivered directly by the Company.
● Once goods, products or services have been delivered it is agreed that the winning applicant will take responsibility to ensure these are maintained and used  for their intended use. Failure to do so will result in the awardee’s prize being revoked.
 By applying for the award(s), the applicant acknowledges that he/she has read, understood and accepted the Terms and Conditions of the Tujiamini. 







Terms & Conditions

1. DEFINITIONS ANDINTERPRETATION
1.1.   In these Term and Conditions unless the context otherwise requires:
1.1.1. ‘Applicant’ means a person who registers to take part in the Tujiamini initiative.
1.1.2.  ‘Award’ means the gold, silver or bronze award which shall be rewarded to winning participant(s) in the Tujiamini initiative.
1.1.3.  ‘Company' means Milestone Games Limited
1.1.4. ‘Participant’ means a person or group of persons who successfully registers to take part in the Tujiamini initiative.
1.1.5. ‘Personal Information” means personal identifiable information as prescribed in the Data Protection Act which includes but is not limited to name, identification number, location data.
1.1.6. Tujiamini’ means the initiative created by the Company to identify and nurture sporting talent in Kenya. For the avoidance of doubt this definition includes any successor/future format of this initiative.
1.1.7. ‘Winner’ means a participant(s) who is declared the winner of an Award in the Tujiamini initiative.
1.1.8. You” and “your” or its variants means the Applicant and includes the successors and assigns of the Applicant.

1.2.  In these Term and Conditions, unless the context otherwise requires, any reference to:
1.2.1. words importing singular, shall include the plural and vice versa.
1.2.2. a person includes reference to a body corporate or other legal entity.
1.2.3. any written law includes that law as amended or re-enacted from time to time.
1.2.4. Recitals, Sections, Clauses, and Schedules are to Recitals, Sections, Clauses of and Schedules to these Terms and Conditions.
1.2.5. any party includes that party’s successors and assigns; and
1.2.6. headings and table of contents used in these Terms and Conditions are for reference only and shall not affect the interpretation of these Terms and Conditions in any way. The identification of certain breaches in these Terms and Conditions as being “Material” does not indicate that only those breaches are material.

2. Acceptance of Term and Conditions

2.1. Before opting to register for the Tujiamini Initiative, you should carefully read and understand these terms and conditions as they govern the access, use and operation of your Tujiamini Account.
2.2. If you do not agree with these terms and conditions, please do not register or submit your application to the Tujiamini Initiative.
2.3. You will be deemed to have read, understood and accepted these terms and conditions:
a) upon submitting your application for the Tujiamini Initiative;
b) and or By using or continuing to use and operate your Tujiamini Initiative Account.
2.4. By registering for the Tujiamini Initiative, you agree to comply with and be bound by these terms and conditions as amended and revised from time to time and you affirm that these terms and conditions are without prejudice to any other rights that the Company may have in law or otherwise regarding your registration, access and use of the Account and/or the Tujiamini Initiative.
2.5. The Company may from time to time vary or amend these terms and conditions and your continued access and use of your account constitutes your acceptance to be bound by the terms of any such amendment or variation.

3. Age
3.1.  You can only apply if:
a)    you are 18 years or over on the day of entry.
b)    by submitting, a certified form of Identification (National ID, or Passport) in the application process to confirm your Name, Date of Birth and ID number.
c)    the order of your name in the application matches that on your National ID, or Passport.
3.2.  All Cheza Dimba applications must come from senior teams playing in the Regional Leagues or below. A team is considered a senior team if it has          achieved the top 3 positions in any of the regional Leagues in the last three years preceding the award.

4. Residency
4.1.  At the time of the application, the applicant must be a resident in Kenya and provide proof of the said residency.
4.2.  The proof of residency shall be by provision of a current utility bill, lease and or title deed.
4.3  The Company reserves the right to conduct its own due diligence and confirm the authenticity of residency of any applicant in Kenya.  

5. Application
5.1.  All the required details in the application forms must be completed in FULL.
5.2.  Applicants must submit all correct information, any information provided and found to be misleading will result in the non-consideration of your application.
5.3.  Applicants must provide a valid reference with their up-to-date contact details when applying for Gold or Silver Awards.
5.4.  Applications must be submitted prior to your region’s competition deadline. No late entries will be accepted.  
5.5.  You are only allowed to apply for the Gold and/or Silver Award and Cheza Dimba once per year.
5.6.  You are only allowed to apply for one Bronze Award per month.
5.7.  The Company reserves the right to decline an application for any reason. 

6. Winners
6.1.  Applicants will be required to provide accurate and up-to-date contact details during the competition entry process. The Company will use the contact details provided for communication regarding the competition, including notifications of winning.
6.2.  Participants are responsible for monitoring their provided contact details and responding promptly to any communications. The Company shall not be responsible for any consequences resulting from inaccurate or outdated contact information.
6.3.  Participants may update their contact details by following the instructions provided on the competition website or by contacting the designated support contact.
6.4.  The Company’s representatives will carry out due diligence on all shortlisted applications for Gold and Silver Awards. Failure to comply with the lawful directions issued by the Company’s representatives will result in non-consideration of the Applicant’s application. Only winners will be contacted.
6.5.  All goods, products and services under the Gold & Silver Awards will be purchased directly by the Company from identified vetted suppliers. Prizes can be awarded in kind or in cash as seen fit by the company on a case-by-case basis
6.6.  The prize money for all Bronze winners will be paid via Mobile Money, into their respective Bank Accounts, or as provided in the respective application forms.

7. Distribution of all prizes
7.1. All participants, who are natural persons, shortlisted for the gold and silver categories must provide valid proof of being over the age of 18 years old prior to being officially pronounced winners. The Participant must furnish a duly certified national identification card or passport for verification of their age. Failure to provide satisfactory proof of age will result in disqualification, and an alternate winner may be selected.
7.2.  All prizes and awards won through the Tujiamini initiative will be delivered to their respective winners once the prizes/awards are secured by the Company. The Prizes will be delivered to the address indicated in the winner’s application form.

8. Follow up of Winners.
8.1.  Winners in all categories will be subject to follow ups on the use of prizes and awards and agree to their images being used to promote the Tujiamini campaign after be declared the winner.

9. Prize misuse.
9.1.  All prizes and awards won through the Tujiamini Initiative are to be used in accordance with the needs submitted on the applicant’s/winners’ application form. They cannot be sold or otherwise transferred for monetary gain. Failure to adhere to this will result in legal action.

10. Community Engagement
10.1.  All Gold winners must participate in two (2) community engagements within a year of winning.  This will be arranged, with and by the Company.
10.2.  All Silver winners must participate in one (1) community engagement within a year of winning.  This will be arranged, with and by the Company

11. Image Rights
11.1. By participating in this initiative, all Applicants hereby grant the Company and its affiliates, subsidiaries, and assigns the unrestricted right to use, reproduce, and distribute their images and likenesses, captured during any promotional and administrative activities related to the competition, for the purpose of promoting and marketing the Initiative. This includes, but is not limited to, the right to display images and likenesses on the company's website, social media channels, promotional materials, and any other marketing platforms, without any further compensation or approval required.
11.2.The Applicants acknowledge and agree that Company shall be the sole and exclusive owner of all rights, title, and interest in and to the images and likenesses, and they waive any right to inspect or approve the finished product or any associated promotional materials. This grant of rights is perpetual, irrevocable, and worldwide.

12. Retraction of Entry
12.1. An applicant can close his/her Account at any time expressly writing the same to the Customer Care Team at care@ke.sportpesa.co.ke
12.2. Application will be limited to one applicant per account. Failure by any applicant to adhere to this rule is a material breach which grants the Company the right to disqualify, terminate, vary or suspend some or all of the Accounts held by the applicant(s) (at its discretion) and take whatever action it reasonably considers appropriate in the circumstances.
12.3. The Company reserves the right to disqualify, terminate, vary or suspend the provision of the Entry, access to Your Account and/or to the Site and/or the App, and refuse any and all current or future entry of the Campaign by You, immediately and without giving You prior notice:

13. Inactive Entries
13.1. Application entries that are submitted with no substantive content, incomplete, or deemed inactive will be considered invalid and may be disqualified from the competition. Participants are reminded to ensure that their application entries contain the required information and materials as specified in the competition guidelines
13.2. The Company reserves the right to reject, in its sole discretion, any application that does not meet the specified criteria or fails to provide meaningful content. Participants are encouraged to carefully review and adhere to the competition guidelines to ensure the eligibility and validity of their entries.  shall not be responsible for any consequences arising from inactive or empty entries, and such entries may be excluded from consideration without notice.

14. Site Access
14.1. Participants are responsible for their own access to the competition website. The Company does not guarantee uninterrupted or error-free access to the site and reserves the right to suspend, modify, or terminate access for maintenance, upgrades, or any other reason.

15.  Limitation & Liability
15.1. The Company and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of the participant’s access to, use of, or inability to use the competition, even if advised of the possibility of such damages. Participants acknowledge and agree that their participation is at their own risk. The Company is not responsible for any lost, late, misdirected, or incomplete entries, or for any technical malfunctions that may occur.

16, Exclusivity Agreement
16.1. All Winning Applicants for Gold and Silver Awards acknowledge and undertake that, during the tenure of the award (January-December 2024), they will not engage in any activity with and/or be associated with any other competing gaming and/or betting entity in any capacity.
16.2 All Winning Applicants for Cheza Dimba acknowledge and undertake that, during the tenure of the award (3 Years), they will not engage in any activity with and/or be associated with any other competing gaming and/or betting entity in any capacity will be required to uphold this for the duration of the prize.

17. Personal information
17.1. You hereby expressly consent and authorize the Company to disclose receive record or utilize your personal information or information or data relating to your account and any details of your participation in the Tujiamini Initiative:
17.1.1. to and from our service providers, agents or any other company that may be or become our affiliate or subsidiary or holding company for reasonable commercial purposes relating to the Tujiamini Initiative;
17.1.2. to our lawyers, auditors or other professional advisors or to any court or arbitration tribunal in connection with any legal or audit proceedings;
17.1.3. for reasonable commercial purposes connected to your use of and or participation in the Tujiamini Initiative, such as marketing and research related activities; and
17.1.4. in business practices including but not limited to quality control, training and ensuring effective systems operation.
17.2. You shall notify the Company in writing of any changes to your Personal Information or update the same on your account including but not restricted to your name and address. Until such notice is received, your Personal Information shall be deemed to be that which you provided in your application to register for the Tujiamini Initiative.

18. General
18.1. The Company reserves the right to change these Terms and Conditions at any time and without prior notice. The Company will endeavour to inform you about major modifications to the Terms and Conditions. Nevertheless, it is your responsibility to regularly check for any changes. Should you, due to any possible changes, not wish to continue participating in Tujiamini, you can withdraw your entry as set out in clause 12 above. A response will be sent to you within 48 hours confirming receipt of your decision to discontinue your engagement with the Company. Failure by you to receive a message for any reason whatsoever shall not be taken to mean that the Company has any continued obligation towards you from the date of your withdrawal.
18.2. Any update or amendment to these Terms and Conditions including privacy terms will be available on the Tujiamini website www.tujiamini.co.ke/ and will take effect from the date of publication of the update or amendment.
18.3. Any amendments or variations made pursuant to these Terms and Conditions shall thereto take effect on their date of publication or as otherwise provided in such amendment or variation and shall be posted on the Website.
18.4. By agreeing to these Terms and Conditions or by submitting an application under clause 5 above, you accept and agree to be bound by these Terms and Conditions and any amendment or variation thereto and the rules which apply to the various prizes or tournaments from time to time. You are acknowledging that the Company shall retain the right to use from time to time, all data collected to carry out market survey/ campaign /research, send customer satisfaction questionnaires, market and promote its services and those of its affiliated companies.

Cheza Dimba Tournament Rules

●  1. ELIGIBILITY
a. Each applicant and participating team must be a grassroots football team from the specified region(s) duly registered with the relevant and or respective football association or governmental bodies.
b. Each participating team must register a minimum of Sixteen (16) players for the tournament.
c. All applicants will adhere to the Football Kenya Federation (FKF) Rules and Regulations governing Kenyan Football (2019) as may be amended from time to time. Failure by applicant(s) to adhere to the said rules and regulations will entitle the Sponsor to immediately terminate, vary, suspend and or cancel the respective regional tournament, without giving prior notice to the applicant(s).
d. Players will only be eligible to play for the team they are registered under.

● 2. TOURNAMENT FORMAT
a. The tournament will follow a structured format with participating teams placed into two pools as follows:
Pool A: Team 1 + Team 2 + Team 3
Pool B: Team 4 + Team 5 + Team 6
b. Each participating team will play one match against each of the other two teams in its respective pool with the winner of each match being awarded three (3) points for a win and one (1) point to each team in the event of a draw.
c. The respective participating teams that will finish in the top two positions from the two pools will proceed to the semi-final matches to be played as follows:
SEMI-FINAL  1: First Team Pool A vs. Second Team Pool B
SEMI-FINAL 2: First Team Pool B vs. Second Team Pool A
d. The respective teams that will win the semi-final matches will play the final match as follows:
FINAL: Winner Semi-final 1 vs. Winner Semi-final 2
e. In the event of adverse weather conditions or time constraints, the tournament directors reserve the right to modify the tournament format. At their discretion, they may decide to proceed directly from the final pool games to the final match.
In this scenario, the teams finishing first in each respective pool will compete in the final to determine the tournament champion.

● 3. MATCHES FORMAT
a. Match Duration: Each match will consist of two halves each lasting twenty(20) minutes with a five (5)minutes half-time interval.
b. Substitutions: Each team will be allowed to make a maximum of five (5)substitutions per game.
c. Tie breakers: In the event of a draw at the end of regulation time in any of the knockout matches (semi-finals and final), the match(es) will proceed to a penalty shootout to determine the winner(s).
d. Officiating: The Referees will manage the matches and all incidental activities in the match and the referees’ on field decisions will be final and binding.

● 4. PLAYING KITS
a. All participating teams will be provided with full playing kits for the matches by the sponsor and the playing uniforms/kits for the tournaments shall not feature any mark/logo of third parties, except upon prior written approval of the Sponsor for such purpose.

● 5. FAIR PLAY
a. All the participating teams will conduct themselves in a sportsman like manner and adhere to FIFA fair play rules and principles.

● 6. IMAGE RIGHTS
a. As consideration for application, registration and participation in this tournament the team hereby consents and agrees that the Sponsor, its agents, and or licensees may make video, audio recordings and/or otherwise films and photographs incidental to the tournament, and therefore grants to the Sponsor, its agents, licensees, successors and assigns, a worldwide, perpetual ,irrevocable, fully-paid, royalty-free right and license to use, copy and disseminate the team’s players’ images, and to modify and present same in any form, manner and media, now known or hereafter devised, for any purpose whatsoever.

● 7. REPRESENTATION AND WARRANTY
a. The team hereby warrants and guarantees to and in favor of the Sponsor that all its players are medically fit for all purposes of the tournament and as at the time of the tournament.
b. By virtue of participation in the tournament, the team warrants, guarantees and acknowledges that it understands and will assume all risks relating to and or that may arise from the respective football matches, including but not limited to bodily injury to its players, partial or total disability to its players, paralysis and or death and indemnifies the Sponsor of any liability arising from such risks.

● 8. INJURIES
a. The team warrants, guarantees and acknowledges that it will assume all risks relating to and or that may arise from the respective football matches, including but not limited to bodily injury to its players, partial or total disability to its players, paralysis and or death and indemnifies the Sponsor of any liability arising from such risks.

● 9. WAIVER OF LIABILITY
a. The team waives, releases and relinquishes any and all claims for liability and cause(s) of action, including for personal injury, property damage or wrongful death arising out of participation in the tournament, and/or activities incidental there to, whenever or however they occur and for such period said activities may continue, and any such claims, rights, and causes of action that the team may have are hereby waived, released and relinquished.
